Speedy Rewards Celebration Official Rules

Effective September 19, 2008, due to technical problems caused by Hurricane Ike, these Official Rules were amended to extend the termination date of the Promotion by one day to 11:59 p.m. CT, October 1. PINs will still stop being issued at 11:59 p.m. CT, September 30 but PINs can be entered and played up to 24 hours later.

NO PURCHASE NECESSARY TO PLAY OR WIN A PRIZE.

  1. HOW IT WORKS:

    From September 2, 2008 through September 30, 2008, or while supplies last (the "Sweepstakes Period"), contestants may visit participating Speedway SuperAmerica ("Sponsor") locations and enter for a chance to win one of the prizes specified below.

  2. ELIGIBILITY:

    Open to legal U.S. residents who are 18 years of age or older at time of entry and who are, or who register to become, Speedway SuperAmerica Speedy RewardsŪ members prior to play. Void in Florida, New York, Rhode Island, West Virginia, Puerto Rico and where prohibited by law. Speedy Rewards Fleet Card members are not eligible to play. Employees of Sponsor, its parents, affiliates and subsidiaries, participating advertising and promotion agencies and prize suppliers (and members of their immediate family and/or those living in the same of household of each) are not eligible.

  3. HOW TO PLAY:

    From September 2, 2008 through September 30, 2008, or while supplies last, an eligible contestant may make a Speedy Rewards purchase at a participating Sponsor location and receive a Speedy Rewards receipt along with his/her transaction receipt containing a 9-character alpha-numeric PIN ("PIN"). The contestant may then visit Sponsor's sweepstakes website at www.speedyrewards.com, log in to his/her Speedy Rewards account (or register for such account if contestant does not already have one) and click on the sweepstakes link. The contestant will then be prompted to enter the PIN as directed, which will allow the contestant to play the sweepstakes game. The deadline for playing the sweepstakes game is 11:59 p.m. CT, October 1. At the conclusion of said game, the contestant will instantly receive a message ("Screen Shot") notifying the contestant whether or not he/she is a winner. Each unique PIN is eligible for only one (1) play attempt and may not be entered more than one (1) time. If a winning message (i.e., Screen Shot stating that the contestant is a winner) is received in response to entering the unique PIN as directed herein, said contestant is a potential winner of one of the prizes specified herein, subject to contestant eligibility. Limited to ten (10) PINs/plays per day per contestant. A confirmation e-mail will be sent to the winning contestant at the e-mail address provided by contestant in his/her Speedy Rewards account registration information. Prizes in the form of Speedy Rewards points will be added to a contestant's Speedy Rewards account within six (6) to eight (8) weeks after confirmation of eligibility. A confirmation e-mail will be sent once the points have been added to the account. Prizes in the form of gift cards will be shipped via regular U.S. Mail to the address provided by a contestant in his/her Speedy Rewards account registration information. All potential winners are subject to verification of eligibility and compliance with the sweepstakes rules before any prize will be awarded. All taxes on any prize are the sole responsibility of the winner.

  4. TO OBTAIN A PIN WITHOUT PURCHASE:

    During the Sweepstakes Period, individuals may visit participating Sponsor locations and acquire a Speedy Rewards Membership card. Upon acquiring a card the individual may take the card to the in store Speedy Rewards Terminal. Once the card has been scanned at the Terminal, individual may press "View Balances", "View Balances", and then "Print Statement & Coupons." At this time a PIN will be printed for use. The PIN can then be entered at www.speedyrewards.com after the individual has registered as a Speedy Rewards member. Thereafter, such individuals may visit Sponsor locations and receive up to ten (10) free PINs per day by swiping their Speedy Rewards cards. To obtain a free PIN by mail, print your name and complete mailing address (no P.O. boxes) on a 3 x 5 card, and send it along with a self-addressed stamped envelope to: Speedy Rewards Celebration, 693 East Ave, Rochester, NY 14607. Limit ten (10) PIN request(s) per household per day. Each request must be mailed in a separate envelope. Requests must be received by September 19, 2008. Vermont residents are not required to include return postage. Available while supplies last.

  5. CONDITIONS OF PARTICIPATION:

    If due to printing, production or other errors, more prizes are claimed than intended, the intended prizes will be awarded in a random drawing from all those submitting purportedly valid claims. No more than the number of prizes set forth in these Official Rules will be awarded. PINs not legitimately obtained and/or used in accordance with these rules are void. Use of any automated system to participate is prohibited and will result in disqualification. ALL POTENTIAL WINNING PLAYS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING. A "SCREEN SHOT" IS NOT PROOF OR EVIDENCE OF A WINNING GAME PLAY AND/OR PRIZE. A CONTESTANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE INSTANT WIN GAME SHOULD SO INDICATE, UNLESS AND UNTIL SAID CONTESTANT'S ELIGIBILITY AND THE POTENTIAL WINNING PLAY HAS BEEN VERIFIED AND SAID CONTESTANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOT ACCEPT SCREEN SHOTS OR OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS. ANY PLAY THAT OCCURS AFTER THE SYSTEM HAS FAILED FOR ANY REASON IS DEEMED A DEFECTIVE PLAY AND IS VOID AND WILL NOT BE HONORED. No transfer, assignment or substitution of a prize will be permitted, except Sponsor reserves the right to substitute prize for an item of equal or greater value in the event an advertised prize is unavailable. All federal, state and local laws and regulations apply. Contestants agree to be bound by the terms of these Official Rules and by the decisions of Sponsor, which are final and binding on all matters pertaining to this sweepstakes. Confirmation e-mails returned as undeliverable may result in disqualification. Acceptance of a prize constitutes permission for Sponsor and its agencies to use winner's name and/or likeness for advertising and promotional purposes without additional compensation, unless prohibited by law. By accepting prize, winners agree to hold Sponsor, its respective directors, officers, employees, assigns, and advertising and promotional agencies harmless for any injury or damage caused or claimed to be caused by participation in the Promotion. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the sweepstakes or in the announcement of the prize. Sponsor is not responsible for lost, stolen, or damaged Speedy Rewards cards, gift cards or PINs.

  6. PRIZES AND APPROXIMATE RETAIL VALUES:

    1,450 prizes of Ten Thousand (10,000) Speedy Rewards points (except for Wisconsin residents, who will have the choice of receiving their prize in the form of 10,000 Speedy Rewards points or a $10 Speedy Cash Gift Card and 1,500 Speedy Rewards points) and four (4) prizes of One Million (1,000,000) Speedy Rewards points are available to be won. Odds of winning any prize specified above depend on the date and time of entry.

  7. INDEMNIFICATION:

    By participating, contestants agree to release, discharge, indemnify and hold harmless Sponsor and each of its respective officers, directors, employees, representatives, agents, advertising and promotional agencies from and against any claims made by winners, entrants, or any other third parties, related in any way to the operation of this Promotion as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any sweepstakes-related activity or participation in this sweepstakes.

  8. INTERNET:

    In the event of a dispute as to any registration or play, the authorized account holder of the Speedy Rewards account will be deemed to be the registrant or player. The "authorized account holder" is the natural person assigned a Speedy Rewards account by Sponsor or other entity responsible for assigning Speedy Rewards accounts for the Sponsor. Potential winners may be required to show proof of being the authorized account holder. Sponsor is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive information by Sponsor on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof. If for any reason the sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes, technological or otherwise, which corrupt, disrupt or otherwise affect the administration, security, fairness, integrity, or proper conduct of this sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend any and all aspects of the sweepstakes. Sponsor reserves the right, but not the obligation, to randomly select winners from eligible entries received as of the termination date. Sponsor further reserves the right to disqualify any individual who tampers with the entry process. Caution: Any attempt by any individual to deliberately damage any Web site or undermine the legitimate operation of the sweepstakes is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such individual to the fullest extent of the law.

  9. GOVERNING LAW; DISPUTES:

    Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Southern District of Ohio or the appropriate Ohio State Court located in Montgomery County, Ohio; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion but in no event attorneys' fees; and (iii) under no circumstances will a participant be permitted to obtain awards for and participant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. Except where prohibited by law, all issues concerning the construction, validity and enforcement of these Official Rules, or the rights and obligations of the entrant and Sponsor, shall be construed and governed by the laws of the state of Ohio, without regard to conflicts of law rules.

  10. WINNERS' LIST:

    For the names of winners, send a separate self-addressed, stamped envelope to: "Speedy Rewards Celebration Winners List," 8300 Douglas Ave, Ste 623, Dallas, TX 75225. Requests must be received by October 31, 2008.
